I haven't bought tuna in oil in 20 years. Can this be made with tuna packed in water or broth?

Yes - it will work with any tuna, you may just need an extra tablespoon of yogurt to keep the patties together since tuna packed in water is a bit drier. With that said, I do recommend trying this particular tuna in oil - it's really good.
